Board of Pharmacy: Temporary Administrative Regulation Article 20.—CONTROLLED SUBSTANCES
68-20-33. 6-(2-chlorophenyl)-1-methyl-8-nitro-4H-benzo[f] [1,2,4]triazolo[4,3-a][1,4]diazepine included in schedule I. 6-(2-chlorophenyl)-1-methyl-8-nitro-4H-benzo[f] [1,2,4]triazolo[4,3-a][1,4]diazepine (other name: clonazolam), including its salts, isomers, and salts of isomers, shall be classified as a schedule I controlled substance. 68-20-32. 8-bromo-6-(2-fluorophenyl)-1-methyl-4H-benzo[f][1,2,4]triazolo[4,3-a][1,4]diazepine included in schedule I. (a) 8-bromo-6-(2-fluorophenyl)-1-methyl-4H-benzo[f][1,2,4]triazolo[4,3-a][1,4]diazepine (other name: flubromazolam), including its salts, isomers, and salts of isomers, shall be classified as a schedule I controlled substance.(b) This regulation shall expire on July 1, 2024. A public hearing will be conducted at 9:00 a.m. Friday, December 8, 2023, in the Headquarters Main Conference Room at the Kansas Bureau of Investigation (KBI), 1620 SW Tyler, Topeka, Kansas, to consider the adoption of a proposed rule and regulation of the Kansas Bureau of Investigation (KBI), on a permanent basis. All interested parties may submit written comments prior to the hearing to the Kansas Bureau of Investigation, 1620 SW Tyler, Topeka, KS 66612, or by email to Bryan.Ross@kbi.ks.gov. 
K.A.R. 10-22-1 – Approved field tests. This regulation lists approved field tests for controlled substances. For admission of field test results at a preliminary examination, law enforcement officers are required to use the field tests specified in this regulation. The proposed amendments to K.A.R. 10-22-1 will add an immunoassay-based field test approved by the Director of the Kansas Bureau of Investigation for detection of fentanyl, specifically DetectaChem Inc.’s MobileDetect™ Fentanyl Test Strip Kit.
Issue 39 - September 28, 2023
A public hearing will be conducted at 8:30 a.m. Thursday, December 7, 2023, at the Office of Administrative Hearings, 1020 S. Kansas Ave., Topeka, Kansas, to review and consider the adoption of a proposed permanent regulation of the Kansas State Board of Pharmacy. K.A.R. 68-20-33. 6-(2-chlorophenyl)-1-methyl-8-nitro-4H-benzo[f] [1,2,4]triazolo[4,3-a][1,4]diazepine included in schedule I. Pursuant to the Board’s emergency scheduling authority, the proposed permanent regulation would place clonazolam in schedule I of the Kansas Uniform Controlled Substances Act until July 1, 2024, giving the Kansas legislature sufficient time to consider the drug for permanent scheduling. 

The Kansas Department of Health and Environment (KDHE), Division of Environment, Bureau of Environmental Remediation, will conduct a public hearing at 10:00 a.m. Friday, December 15, 2023, in Room 530, Curtis State Office Building, 1000 SW Jackson, Topeka, Kansas, to consider the adoption of proposed amended spill reporting regulations K.A.R. 28-48-1 and 28-48-2 and the adoption of proposed new spill reporting regulations K.A.R. 28-48-3 and 28-48-4.

A public hearing will be conducted at 9:00 a.m. Friday, October 27, 2023, in the Headquarters Main Conference Room at the Kansas Bureau of Investigation (KBI), 1620 SW Tyler, Topeka, Kansas, to consider the adoption of proposed rules and regulations of the Kansas Bureau of Investigation (KBI), on a permanent basis. The amendments are to KAR 10-21-1; 10-21-3; 10-21-4; 10-21-5; and 10-21-6, all related to the DNA database. See page 1038 at the link above for details. All interested parties may submit written comments prior to the hearing to the Kansas Bureau of Investigation, 1620 SW Tyler, Topeka, KS 66612, or by email to Bryan.Ross@kbi.ks.gov. All interested parties will be given a reasonable opportunity to present their views orally regarding the adoption of the proposed regulations during the public hearing. In order to provide all parties an opportunity to present their views, it may be necessary to request that each participant limit any oral presentation to five minutes.

The Kansas Criminal Justice Coordinating oversees the Federal Edward Byrne Memorial Justice Assistance Grant (JAG). The JAG program guidelines establish eligibility criteria for all organizations receiving JAG funds. Eligible applicants for JAG funding include units of state and local government; Native American Tribes; and nonprofit, community, and faith-based organizations, including underserved and culturally specific populations. Priority will be given to applications clearly supporting the objectives of the current Kansas Statewide Strategic Plan and submitting a complete application. A copy of the Strategic Plan, as well as a copy of the JAG solicitation, may be downloaded at https://grants.ks.gov/grant-programs/edward-j-byrne-memorial-justice-assistance-grant-(jag). The solicitation is also available on the Kansas Governor’s Grant Portal at https://www.kansas.gov/grants/index.do. All grant applications must be submitted via the Kansas Governor’s Grant Portal by 11:59 p.m. September 14, 2023. K.A.R. 16-19-1 provides definitions of terms used in the new Article 19 regulations. No economic impact is anticipated.
K.A.R. 16-19-2 establishes the VINE Advisory Board and provides for the selection of the members of the board by the attorney general. Further, the regulation re-quires the board to meet at the call of the VINE coordina-tor and to maintain minutes of its meetings. No economic impact is anticipated.
K.A.R. 16-19-3 requires the VINE Advisory Board to ad-vise and make recommendations to the attorney general for the implementation and operation of the VINE pro-gram. The board and members of established subcom-mittees or working groups would be required to com-ply with the Kansas Open Meetings Act and the Kansas Open Records Act. Further, the board may be assigned legal counsel or other support staff as determined by the attorney general. No economic impact is anticipated.

10-22-1. Approved field tests.
(a) Law enforcement
officers shall use only the field tests specified in this reg-ulation on suspected controlled substances for admission of the field test results at any preliminary examination pursuant to K.S.A. 22-2902, and amendments thereto.
(b) The following reagents shall be the only reagents
approved by the director of the Kansas bureau of investi-gation (KBI) for reagent-based field tests:(1) Chen’s reagent;(2) cobalt thiocyanate reagent;(3) Dille-Koppanyi reagent;(4) Duquenois-Levine reagent;(5) Ehrlich’s reagent;(6) fast blue B or BB reagent or the salts of either reagent;(7) Fröhdes reagent;(8) Mandelin reagent;(9) Marquis reagent;(10) Mecke’s reagent;(11) nitric acid reagent;(12) Sanchez reagent;(13) Scott reagent;(14) sodium nitroprusside reagent, which is also known as nitrosylpentacyanoferrate, nitroprussidnatrium, sodi-um nitroprussate, sodium nitrosylpentacyanoferrate, or disodium pentacyanonitrosylferrate. This reagent may be used only in conjunction with the Marquis reagent; and(15) Zwikker reagent.
(c) The following instruments shall be the only instru
-ments approved by the director of the KBI for instrument-based field tests:(1) B&W Tek TacticID®-N handheld Raman analyzer, without utilizing the “mixture ID” software feature; and(2) Thermo Scientific TruNarc™ handheld narcotics analyzer.

Grant funds are available from the Federal Victim Assistance of Crime Act (VOCA) Victim Assistance grant program for the funding period of October 1, 2019, through September 30, 2020, to eligible applicants. For the purpose of these grant program guidelines, direct services are defined as those efforts that (1) respond to the emotional and physical needs of crime victims; (2) assist primary and secondary victims of crime to stabilize their lives after a victimization; (3) assist victims to understand and participate in the criminal justice system; and (4) provide victims of crime with a measure of safety such as boarding up broken windows and replacing or repairing locks.  A crime victim is a person who has suffered physical, sexual, financial, or emotional harm as a result of the commission of a crime. all organizations receiving JAG funds.

Grant funds are available from the Federal Victims of Crime Act (VOCA) Victim Assistance grant program. The purpose is to fund public agencies, nonprofit, community, and faith-based organizations that provide direct assistance to crime victims. For the purpose of these grant program guidelines, direct services are defined as those efforts that (1) respond to the emotional and physical needs of crime victims; (2) assist primary and secondary victims of crime to stabilize their lives after a victimization; (3) assist victims to understand and participate in the criminal justice system; and (4) provide victims of crime with a measure of safety such as boarding up broken windows and replacing or repairing locks.  A crime victim is a person who has suffered physical, sexual, financial, or emotional harm as a result of the commission of a crime.
